Abstract: In 1990, at the beginning of the transition period, the privately-owned small and medium enterprises were non-existent. Afterwards, the necessary legislative framework was created and there came into being a significant number of small and medium enterprises. In 2002 the density of SME to 1,000 inhabitants was 19. It should be mentioned that the value of the same indicator within the EU was 53/1000 inhabitants. During the last years, significant progress has been made on the obtaining of the legal and institutional framework that would support the development of the small and medium enterprises in Romania. The economic performances of these have constantly improved.
