Abstract: Since an intellectual property (IP) system was formally established in China in the early 1990s, a great deal has been written about the merits and drawbacks of the system from a legal perspective. However, a systematic study of the IP system is required. The purpose of this paper is to systematically review the current IP system from three aspects - legislation, enforcement and administration. Moreover, it also analyses the IP activities in China in the last two decades. Additionally, it critically assesses the problems of the emerging IP system. The paper conclusively implies that constant improvements are needed in legislation, administration and enforcement, in order to create a secure IP environment in China with IP policy and practice in line with the international standard.
