Title: Hearing the witness remotely in Jordanian law

Abstract: This study examines the regulation of remote witness testimony in Jordanian legislation and evaluates the adequacy of the legal framework governing the use of electronic means in civil and arbitration proceedings. The study adopts a doctrinal legal research methodology based on the analysis of Article 81(7) of the Jordanian Code of Civil Procedure, Article 32(h) of the Arbitration Law and its amendments, and the System for the Use of Electronic Means in Civil Judicial Procedures No. 95 of 2018, with reference to the IBA Rules on the Taking of Evidence. The study finds that, despite legislative recognition of remote testimony, the existing framework contains procedural and evidentiary shortcomings that may affect the reliability and effectiveness of witness examination. The study concludes that greater legislative clarity and procedural safeguards are required and recommends aligning Jordanian regulations with international best practices governing electronic evidence and remote witness testimony.
