International Journal of Intellectual Property Management (IJIPM), Vol. 7, No. 1/2, 2014

Abstract: This article presents an overview of the consumer's protection against false trade descriptions in light of the Jordanian legislation. Although false trade descriptions are specifically regulated in Jordan under the Goods Marks Law, the aforementioned law is not inclusive and some of the relevant provisions are scattered across other laws. It is necessary to provide consumers with clear and deterrent protection, be it criminal or civil, under one comprehensive law against the practice of false trade descriptions. The author in this article will distinguish between 'trade description' and 'false trade description', and will examine the types of trade descriptions, i.e., legal and false trade descriptions, in addition to the criminal and civil protections against false trade descriptions.
