Aviation security: legal framework and technical management

Abstract: Aviation security is a concept that is indeed multifaceted. It touches upon many people's lives every day and in many ways. Not only business travellers and tourists are affected by aviation security measures. The media also portray the different measures and their consequences with great interest, thus bringing the concept of aviation security to the general public. The strengthening of aviation security is the objective of many legal instruments. These legal instruments are to be found on different levels, some global or regional, others national, and they vary in specific purposes and contents. Some instruments are closely connected to criminal law governing, among other things, the punishment of alleged offenders. Other instruments lay down rules on very specific security measures, e.g., the regulation on identification documents. This paper sets forth some of the legal instruments that have relations to aviation security. It also takes a look at some of the more technical aspects of aviation security. Furthermore, the paper addresses some of the legal problems arising out of the use of new security technologies. The paper is to be viewed as an appetiser that gives only a general survey of some of the legal and technical aspects of aviation security.
