Abstract: The present discussions related to the domain name system mainly concern administrative and organisational questions. Substantive topics, however, are also important. Based on a self-regulatory model, this paper develops ideas towards the introduction of a Domain Name Code which gives harmonising guidelines on the basis of the notion of a distinctive sign; the paper addresses the major substantive aspects of a legal framework for domain names, namely validity requirements, special registration rules, new classification, right of priority and protection, forms of use, registration formalities, cancellation, assignment and pledge, dispute resolution and so on.
